1. Acceptance of Terms
By accessing or using the Podium platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms form a binding legal agreement between you and Podium Insurance Brokerage LLC.
We may update these Terms from time to time. Continued use of the Service after changes constitutes your acceptance of the updated Terms, subject to the notice requirements in Section 9.
2. Services
Podium operates an online insurance comparison platform. We provide a platform that connects consumers with multiple auto insurance carriers to facilitate rate comparisons and, if desired, policy switching.
Podium is not an insurer and does not underwrite policies. We do not set insurance rates, make coverage decisions, or assume any insurance risk. All policies are issued directly by the insurance carriers you choose.
Our Service is free to consumers. We are compensated through referral arrangements with participating carriers when a consumer switches carriers through our platform.
3. Eligibility
To use the Podium Service, you must:
- Be at least 18 years of age
- Be a legal resident of the United States
- Have a valid auto insurance policy or own a vehicle you wish to insure
- Provide accurate and truthful information throughout the process
By using the Service, you represent and warrant that you meet all of the above eligibility requirements.
4. User Responsibilities
You are responsible for the accuracy and completeness of all information you provide through the Service. Inaccurate information may result in incorrect quotes or, if you purchase a policy, a carrier's right to void your coverage.
You agree to:
- Provide truthful and accurate information about yourself and your vehicle(s)
- Notify us promptly if any information you've provided becomes inaccurate
- Not use the Service for any fraudulent, illegal, or unauthorized purpose
- Not attempt to reverse-engineer, scrape, or interfere with the platform
- Maintain the security of your account credentials
5. Our Role
Podium acts as your agent in obtaining insurance quotes from carriers. We present options to you but do not make coverage recommendations or provide licensed insurance advice unless explicitly indicated.
Final policy terms, pricing, exclusions, and conditions are determined solely by the insurance carrier you select. We encourage you to review all policy documents carefully before binding coverage. Podium is not responsible for a carrier's coverage decisions, claims handling, or changes in pricing after a policy is issued.
6. Intellectual Property
All content, software, trademarks, logos, trade dress, and technology on the Podium platform are the exclusive property of Podium Insurance Brokerage LLC. or our licensors, and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any part of the Service without our prior written consent.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PODIUM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability to you for any claims arising from or relating to these Terms or the Service shall not exceed the greater of (a) $100 or (b) the total fees, if any, paid by you to Podium in the twelve months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental damages, so the above limitations may not apply to you.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.
9. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, technology, or applicable law. When we make material changes, we will notify you by email (to the address associated with your account) at least 30 days before the changes take effect.
If you do not agree to the updated Terms, you may close your account before the effective date of the changes. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
